Plea bargain: 13 years for brutal attack

"Driving force" behind the 2006 Haifa attack on 69-year-old makes deal; victim: It's just not enough.

A plea bargain was submitted to the Haifa District Court on Monday, which would put Stephan Borisevski, 21, allegedly the "driving force" behind the brutal attack on 69-year-old Ita Fogel, behind bars for 13 years. In the plea bargain, Borisevski admitted to the attack and robbery of the elderly woman some two years ago. Before the start of the hearing, however, the man said he was pressured to admit to the offenses because the other two men involved in the attack, Arik Schechter and Liran Hubert, had testified against him. "I didn't touch her at all," he claimed, adding that his role in the attack was merely to "search for the money." Fogel was severely beaten, had burning cigarettes extinguished on her back and had bleach and cold water poured over her body. The three men allegedly attacked her, apparently believing that she had money stashed in her Haifa apartment. The men also carried a box cutter and threatened to kill her if she did not tell them where the money was. The torment went on for three hours and Fogel was hospitalized for more than a month. Exposure to the bleach caused her respiratory difficulties and she was hospitalized in intensive care. In response to the plea bargain, Fogel told Israel Radio that the 13-year suggested sentence was insufficient. "It's just not enough. He was the main guy in all this. He put cigarettes out on me, used electric shocks and poured bleach on me," she said, adding, "However, I would still like to thank everyone: the police, the State Prosecutor's Office and the press." When told that the accused had expressed their regret, Fogel responded that it "wasn't enough... I am not a little girl that they can just tell me they are sorry. Such parasites need to get more [prison] time." Fogel said that she has yet to fully recover from the attack. "My head is spinning and I am unable to stand straight. I also have another operation to undergo this month. It can't just pass in two years; I'm not a 16-year-old. It's not easy." Fogel said she insisted on going to court throughout the trial. "It was important for me to see how these people can do such a thing. They can try it on their parents, not on me." In September, the Haifa District Court sentenced Hubert, 26, of Haifa, to 10 years in jail and gave him a two-year suspended sentence as part of a plea bargain reached for his part in the attack. Hubert was initially charged with robbery, sabotage and use of controlled substances. As part of the plea bargain, the charges of sabotage were dropped. He was also ordered to compensate Fogel to the sum of NIS 17,000. Just over a year ago, Schechter, 25, was sentenced to 11 years in prison for his part in the attack. Schechter was also ordered to pay Fogel NIS 20,000 in compensation.
