Demjanjuk extradition request denied by German court

A Munich court has denied Spain's request to extradite John Demjanjuk, a former guard at the Sobibor death camp in then-occupied Poland, to stand trial in Madrid, the Associated Press reported Thursday.

Demjanjuk, who was convicted in Germany in May of 28,060 counts of accessory to murder, denies serving as a guard at the Nazi camp and currently remains out of prison, pending his appeal against his conviction and a five-year sentence.

Demjanjuk was indicted in January by Spain on charges of accessory to genocide and crimes against humanity related to his time in the Flossenbuerg concentration camp in southern Germany, where 155 Spaniards were held and 60 were killed.

However, court spokeswoman Margarete Noetzel said Thursday that the decision to deny his extradition, which was made May 31, was influenced by the fact that the evidence presented in the indictment against Demjanjuk was incomplete, missing crucial information regarding details of the deaths of Spanish citizens and Demjanjuk's involvement in the deaths. Spain's jurisdiction was also questioned as the alleged crimes were committed in Germany.
