The High Court of Justice on Monday rejected requests for an interim injunction by the Bir Naballah local council against the army's intention to confiscate land for the separation wall immediately east of the town.
The court accepted the state's argument, presented on Sunday, that there is "a vital security need" for access to Jerusalem to be cut off, since it is possible to reach Bir Naballah from any point in the West Bank north of Bir Naballah.
Marc Luria, founder of Security Fence for Israel, told The Jerusalem Post that "perhaps if the court had made this decision earlier, Monday's suicide bombing attack in Tel Aviv would not have occurred."
Since it will take at least several weeks to build the wall, in the meantime the army plans to build a chain link fence to immediately block off the road leading from Bir Naballah to A-Ram and Jerusalem.
