Kuwait: Terrorism case goes back to appeals court

The country's highest court ruled Wednesday that the law under which several suspected terrorists were convicted of plotting to attack US troops was constitutional, effectively sending the case back to an appeals court. In May, an appeals court said it had strong reservations about the main charge of "conspiring to commit a crime," because people cannot be held accountable for intentions. It stopped hearing the case against the 34 defendants and asked the Constitutional Court to decide whether the pertinent article of the penal code was constitutional. A criminal court had condemned to death six of the defendants and sentenced 21 others to prison. Six were acquitted. The wife of one of them, who has since died of cancer, was convicted but she was not sentenced. Both the prosecution and the convicted defendants appealed the criminal court's findings.
