High Court of Justice orders Communications Ministry to pay NIS28,000 to appellants

The High Court of Justice has erased the appeal of Jerusalem Mayor Nir Barkat and Knesset’s Jerusalem lobby against the temporary transfer to Modiin of CAN, the public broadcasting service that will replace the Israel Broadcasting Authority.

The CAN premises still under construction in Jerusalem Givat Shaul neighborhood, are unlikely to be completed before July, 2017. The building was inspected last week by the CAN management which paid NIS88 million for the plot of land, and another NIS 40 million for the actual building which will house the radio and television studios as well as the administrative offices.

The judges noted that the Knesset had amended the public broadcasting law and had reached a compromise whereby Israel Radio news broadcasts would be relayed from Jerusalem, and other broadcasts from Modiin, during the interim period until the Jerusalem facility is ready for occupancy.

The deadline for the move to Jerusalem is July 1.

Deputy Supreme Court President Elyakim Rubinstein underscored that Israel Radio Newscasts are the undisputed showcase of public broadcasting in Israel.

The court had previously issued an interim injunction to which the response by CAN and the Communications Ministry had in the opinion of the court been inadequate. As a result, the court ordered CAN and the Communications Ministry to pay NIS28,000 in costs to the appellants.
