The state on Thursday asked the High Court of Justice to hold a new hearing before an expanded panel to reconsider its decision in favor of a petition prohibiting the army from using the so-called "neighbor procedure."
According to the procedure, the army may ask Palestinians to approach a building sheltering a suspected terrorist and ask the wanted man to give himself up as long as the Palestinian is ready to do so of his own free will and the commander believes that the deed will not endanger his life.
On October 6, the court ruled that the procedure violated international law which prohibits the occupying force from involving protected persons in military situations, even if the protected person gives his consent.
The state said the court ruling was mistaken and that the matter was sufficiently important to be given a second hearing.
