South Africa court prohibits man from sending anti-Semitic emails

Ruling handed down Tuesday by Durban Equality Court Magistrate Aletta Moolman in favor of he South African Jewish Board of Deputies and against Snowy Smith.

A South African court has prohibited a man from wide dissemination of anti-Semitic emails since they “impinge adversely on the dignity of the Jewish people and constitute hate speech.”
The ruling was handed down Tuesday by Durban Equality Court Magistrate Aletta Moolman in favor of the South African Jewish Board of Deputies and against Snowy Smith, who started massively disseminating anti-Semitic emails in October 2010.
In April 2013 the SAJBD filed a hate-speech complaint against Smith, following his dozens of anti-Semitic emails to Jewish individuals and institutions, journalists and news editors.
The matter was heard in the Equality Court on November 16 and 17.
In making her arguments before the court, SAJBD national president Mary Kluk stressed that while the SAJBD “fully supported the right to freedom of expression, the nature of the material disseminated by Snowy Smith crossed the line and could not be tolerated in a free and democratically based constitutional democracy.”
Smith’s emails, quoted by the court, make a range of wild allegations against Jews.
“The Zionist Jew NOW (new world order) hates us Gentiles or Goyim (The White People.) The Zionist Jew NOW plans are to destroy the White Race, steal all the White Man’s assets and force a One World Government, Military Dictatorship on us all,” Smith wrote.
He explained that the Zionist Jews even put Obama in power to bring about this military one world dictatorship.
Smith continued, “The Zionist Jew NOW orchestrated and systematically planned the downfall of every White Owned, White Run Country in Africa, including South Africa using communism.”
Moreover, Smith stated, “The Zionist Jew NOW orchestrated and systematically planned the last World War and almost every war or major revolution in history.”
The email goes on to say that the Jews have a “master plan” laid out in the Protocols of the Elders of Zion, which is “100% True” and accuses the Jews or the Mossad of murdering hundreds of millions of people, including responsibility for the September 11, 2001, terrorist attacks.
Moolman accepted Kluk’s arguments about the emails and wrote that “any reasonable person” would conclude that the emails are not merely offensive but “likely to cause harm.”
Kluk applauded the ruling, saying that “racism in this country will not be tolerated and that religious, ethnic and minority groups are and remain protected within the laws of this country by this important ruling.”
