Admission of guilt by a suspect who is unaware of his right to an attorney would be disqualified and inadmissible in court, the Supreme Court determined on Thursday in an unprecedented ruling.
The decision was reached after an expanded forum of nine judges accepted an appeal by a soldier who admitted to charges of use and possession of illegal narcotics, without being aware of the fact that he was entitled to legal aid.
In addition, the court also ruled that illegally obtained evidence could not be used to seal convictions, after it emerged that the evidence was stolen from the soldier.
Judge Dorit Beinish emphasized that although there was a need to seek the truth and fight crime, it was also important that the defendant's rights would be protected as part of keeping the purity of the prosecutorial procedure as well as justice in its broader sense."
