The lawsuit was filed last week on behalf of Tel Aviv resident Melanie Wolfson, 38, by the Israel Religious Action Center, a division of the Reform movement in Israel.
The study saw researchers analyze and contact all 102 passengers from a March 9 flight from Tel Aviv to Frankfurt, none of whom had worn face masks.
The flight was carrying 190 passengers and crew.
"We believe there are two people dead, and 35 injured, we are still in the middle of the rescue effort."
