High Court rejects petition against 'Nakba Law'

The High Court of Justice on Thursday rejected a petition against the "Nakba Law," by which public funding will be cut off for organizations that recognize the foundation of the State of Israel as the national tragedy of the Palestinian people.

Supreme Court President Dorit Beinisch said that while the petition brought up important issues, the constitutionality of the law could not be properly gauged until it is actually applied.

The petition was filed by the Association for Civil Rights in Israel (ACRI), the Adalah Center for Arab Minority Rights and Prof. Oren Yiftachel, and asks the court to annul the “Nakba Law.”

The law, which was passed in March, enables the finance minister to withhold funds from municipalities and other government-funded bodies that actively work to deny Israel’s existence as a Jewish, democratic state or that mark Independence Day as a day of mourning.

Petitioners have claimed that the bill violates constitutional rights and violates Arab Israelis’ freedom of expression.
