Defendant allegedly raped victim on sofa, knowing she was drunk.

The Jerusalem District Attorney filed an indictment in the district court on Thursday, charging a 24-year-old Sudanese man with raping a high school student.Muhammad Fadoul, who came to Israel as a refugee, allegedly assaulted the 17- year-old complainant after a graduation party last month in Moshav Sdot Micha, west of Beit Shemesh.According to the indictment, in the months preceding the alleged rape, Fadoul worked as a janitor in the Ahuzat Gan Eden villa in Sdot Micha, and slept on a sofa in the living quarters.The owner rented out parts of the villa, including its gardens, as a venue for parties and events.On April 29, the complainant, who has not been named, and her classmates celebrated their high school graduation, and that evening traveled together to the villa for a private party that began in the early hours of April 30.At around 3 that morning, the complainant went to the villa’s living quarters, where Fadoul and another man were sleeping.The complainant was drunk, the indictment said, and had decided to lay down on the sofa next to Fadoul.Realizing she was drunk, Fadoul pulled a cover over her and himself, removed her underwear and raped her, the indictment said.The complainant, who felt pain during the rape, told Fadoul, “Stop, you’re hurting me,” according to the indictment.The indictment said that the complainant’s friends, having realized she was missing, searched for her and at around 4 a.m., they entered the living quarters and found her asleep on the sofa.Allegedly, Fadoul and another man were also present in the room.Fadoul exploited a situation in which the complainant was unable to give her free consent to intercourse, the indictment said.
